General Terms and Conditions 

of the Ski Tále Ski Resort, the Low Tatras

  1. 1. These General Terms and Conditions for the winter ski season 2024/2025 issued by the company Tále, a.s., with its registered office at Tále 100, 977 01 Horná Lehota, company ID: 36028631, registered in the Commercial Register of the Banská Bystrica District Court, Section Sa, File No. 478/S (hereinafter referred to as “Tále, a.s.” or simply the “operator”), regulate the provision of services – transportation by ski lifts, use of ski slopes, the area of the Ski Tále ski resort (including the access road to the resort, parking areas, etc.) and the regulation of rights and obligations related thereto.
  2. 2. By purchasing any ski pass, using the services provided by the operator, staying at the Ski Tále ski resort area, the visitors undertake to comply with the provisions of these General Terms and Conditions, the White Code and the instructions of persons authorized by the operator.
  3. 3. The company reserves the right to amend these General Terms and Conditions as necessary, with the amendment in the conditions being valid on the day following the day of publication on the website www.tale.sk.
  4. DEFINITION OF TERMS

4.1. Ski Tále ski resort area – the lands owned or leased by the operator corresponding to the graphic display on the maps published on the website www.tale.sk.

4.2. Visitor – any natural person located in the Ski Tále ski resort area.

4.3. Ski pass – is a time-limited authorization that allows unlimited use of the ski lifts that are available and operating at the time of use of this authorization under the conditions set out in the General Terms and Conditions. The condition for using a ski pass is the ownership/possession of a card with the recorded time-limited authorization. By purchasing the ski pass, an accident insurance contract of the ski pass holder is also concluded. The validity of the authorization in a given winter season is determined by the type of the ski pass.

There are:

4.3.1. hourly ski pass – is valid for the period of time specified in the ski pass from the moment of card activation, i.e. from the moment of its first use on a given day, but is not valid longer than until the end of the operating hours of the ski lifts on the given day;

4.3.2. daily ski pass – is valid for a specified number of consecutive days, which is stated in the ski pass, from the moment of card activation, non-binding from the hour when the card was activated, but not longer than until the end of the operating hours of the ski lifts on the last day of ski pass validity;

4.3.3. ski pass for the number of rides – is valid for a specified number of rides, it can be used at any time until the end of the ski season.

4.4. Contactless chip card – the carrier of the time authorization resulting from the purchased ski pass, it is the property of the operator.

4.5. Ski slope – a slope prepared and specified by the operator for downhill skiing, snowboarding, cross-country skiing.

4.6. Ski lift – a means of transport ensuring the transport of people on the slope.

4.7. Vending machine – after reading the QR code, the machine issues a chip card with a ski pass loaded on it.

4.8. Self-service machine – a machine that is used to purchase ski passes directly at the ski resort, where only cashless payment is possible.

  1. OPERATION AND OPENING HOURS

5.1. The operation of the individual ski lifts depends on specific weather conditions. The operator reserves the right to close the transport facilities in the event of failures, excessive wind speed, heavy snowfall, fog, power outages, etc.

5.2. By putting the ski lifts into operation, the operator of the Ski Tále ski resort guarantees that the slopes are sufficiently prepared and suitable for safe use. At the same time, the operator is not responsible for changes in the quality of the slopes and the quality of the snow during the operating hours due to the weather conditions.

5.3. The operating hours of the ski lifts and ski slopes are specified by the company Tále, a.s. depending on the weather and operating conditions at the Ski Tále ski resort.

TOP SEASON: 24 December 2024 – 06 January 2025 MAIN SEASON: until 23 December 2024 and from 07 January 2025 until the end of the season.

5.4. Unless otherwise specified by the operator, the operating hours of the ski lifts and ski slopes at the Ski Tále ski resort are from 9:00 to 16:00 during day skiing and from 18:00 to 21:00 during evening skiing.

5.5. From the beginning of the winter ski season to the end of the winter ski season 2024/2025, the SKI SLOPES are CLOSED from 16:00 to 9:00! It is forbidden to enter the ski slopes during the closure! There is a risk of injury from snow guns and from the machines that prepare the ski slopes, especially those using winches with unwound ropes!

5.6. The company Tále, a.s. is authorized to unilaterally change the operating hours of the transport facilities and ski slopes. Information on snow conditions and the operation of ski lifts and ski slopes is available daily at the Ski Tále ski resort ticket offices, as well as on the websites www.tale.sk and www.holidayinfo.sk.

5.7. The operator of the ski resort declares that the resort does not operate any ski mountaineering trails, therefore using the ski slopes in the above-mentioned manner is PROHIBITED!

5.8. It is prohibited to enter the ski slopes with pets, to build slalom trails and various obstacles without the operator’s consent, to ride quad bikes and snowmobiles without the operator’s consent, to enter the ski slopes and ski lifts under the influence of alcohol or other intoxicating agents.

5.9. A skier younger than 15 are years of age is obliged to protect his/her head on the ski slopes with a properly fastened ski helmet.

5.10. The visitors are required to observe warning, instruction and information signs, or other notices in the area and must not destroy, damage or remove them. They are also obliged to respect the instructions and guidelines of persons authorized by the operator.

5.11. The operator uses off-road snow vehicles (snow crawler, snow scooter) to prepare the tracks and control the area which emit sound and light signals. In that case, every visitor to the area is obliged to increase attention, to reduce the driving speed, to avoid the vehicle from a distance or to stop and let it pass.

5.12. In the event that a visitor, through his/her behaviour and actions, threatens or damages the property, interests of the operator or the life, health or property of other visitors to the ski resort area, the operator is entitled to deny the visitor the provision of services or to use all legal means in accordance with the legal regulations for the protection and prevention of damage, while the visitor has no claim to financial or non-financial compensation for the inability to use the services provided by the operator.

5.13. The operator is entitled to limit the scope of use of the ski slopes and the ski lifts by visitors in the event of ski races, organized training sessions of ski clubs or other events for the duration of such races, training sessions or other events. In certain cases, the participants of such events have priority in using the ski lifts.

  1. PURCHASE OF SKI PASSES ONLINE

6.1. All natural and legal persons can purchase tickets online through the online store in accordance with these General Terms and Conditions under the conditions set out below.

6.2. The following types of online tickets can be purchased in the online store:

6.2.1. 2-hour and 4-hour ski passes,

6.2.2. all-day ski passes,

6.2.3. multi-day ski passes.

6.3. The discounted ski passes cannot be purchased online. The discounted tickets can only be purchased in person at the resort’s cash desk during the operating hours upon the submission of the required ID cards.

6.4. The customer purchases ski passes through the online store after completing the mandatory fields in the online store form. This primarily involves 1) selecting the type of ski pass, 2) selecting the form of purchase, 3) entering the contact details, 4) filling in the start of the ticket use, 5) checking the agreement with these General Terms and Conditions, the operator’s valid operating regulations and consent to the processing of personal data, and 6) binding confirmation of the order. The binding confirmation of the order is also considered to be the conclusion of a purchase contract. The customer is then shown the total purchase price, which he/she is obliged to pay via the payment gateway Global Payments, s. r. o. The stated purchase price is the final price, i.e. including all fees. By concluding the purchase contract, the customer confirms that he/she has read and agrees to these General Terms and Conditions.

6.5. The following forms of purchase are available:

6.5.1. With registration, when the customer creates an account on the website https://tale.axess.shop after entering a password. 

6.5.2. The customer has the opportunity to purchase tickets under preferential conditions.

6.6. The purchase of the online ski passes is not conditional on the possession of the ticket carrier – the AXESS chip card (hereinafter referred to as the “chip card”). The chip card is issued in a self-service machine after presenting the QR code to the reader.

6.7. Only one online ski pass can be activated per chip card.

6.8. The use of the chip card and online ski pass is governed by the current operating rules of the operator, which are available at the SKI TÁLE resort cash desk and also on the website www.tale.sk.

6.9. The online ski pass is valid only on the date when the customer chooses to start using it when purchasing the online ticket – a specific day when purchasing, while its validity ends with the expiration of the validity period specified in section 6.2. If the online ski pass is not used on this specific date, without the customer changing the validity date or withdrawing from the purchase contract according to section 4 of these General Terms and Conditions, the online ticket is forfeited without any right to a refund of its purchase price.

6.10. The first time the ticket is passed through the turnstile, it is invalidated and bound to the holder which makes it non-transferable! Only the ticket (the ticket encoded on the chip card) is non-transferable, not the chip card as the ticket carrier.

6.11. The purchased online ticket is activated after the first passage through the turnstile. After the online ticket is activated, it is no longer possible to withdraw from the purchase contract.

6.12. The chip card serves as a travel ticket only after the online ticket is activated in the manner specified in section 6, paragraph 6.10 of these General Terms and Conditions. Until this moment, the chip card does not entitle its holder to travel.

  1. SKI PASSES

7.1.

During the 2024/2025 winter ski season, the visitor has the opportunity to purchase a ski ticket (hereinafter referred to as the “ski pass”) at the prices specified in the price list issued by Tále, a.s. for the 2024/2025 winter ski season. Changes in prices and conditions do not apply to visitors who have already concluded a purchase contract (purchased a ski pass).

7.2. The ski pass is issued by the company Tále, a.s. exclusively in the form of a contactless chip card. The deposit for the chip card is 2 EUR. The ski pass holder can return the contactless chip card on any day until the end of the 2024/2025 winter ski season at the Ski Tále resort ticket offices from 9:00 to 16:15 or during evening skiing from 18:00 to 21:15, or at a self-service machine. The deposit for the contactless chip card in the amount of 2 EUR is refunded in full only if the card is returned undamaged.

7.3. Entry to the slope is only possible with a valid ski pass.

7.4. The ski pass for “evening skiing” is valid exclusively during evening skiing.

7.5. The 1-day ski pass (9:00 – 16:00) is valid for one day during the resort’s operating hours on the day of purchase or on the day stated in the ski pass. The 1-day ski pass does not entitle the holder to evening skiing.

7.6. 2- and 3-day ski passes are valid from the date of purchase of the relevant ski pass or from the date stated in the ski pass for the following 2 or 3 consecutive calendar days, depending on the type of the multi-day ski pass purchased by the customer.

7.7. 4-day and 5-day ski passes are valid from the date of purchase of the relevant multi-day ski pass or from the date stated in the ski pass for the following 7 calendar days (e.g. in the case of a 4 out of 7 ski passes for any 4 calendar days within 7 consecutive calendar days) depending on the type of the multi-day ski pass purchased by the customer.

7.8. Children up to 5 years of age (inclusive) accompanied by an adult older than 18 years of age with a valid ski pass, ski for 2 EUR. No other discounts apply to this ski pass. To claim it, it is necessary to present the child’s insurance card.

7.9. Seniors over 60 years of age / holders of the severe disability card / sever disability S card are entitled to a ski pass at the price of a junior ski pass under the condition that they present their severe disability card / sever disability S card.

7.10. Guests staying at the Stupka Hotel and the Golf Tále dependency hotel are entitled to a 20% discount on four-hour, one-day, multi-day ski passes, and evening skiing upon submitting the accommodation card. One accommodation card is eligible for a discount on only one ski pass for one person.

7.11. The holders of the Horehronie Region Card are entitled to a 10% discount on one to 5-day ski passes upon the submission of this card when purchasing a ski pass. One card is eligible for a discount on only one ski pass for one person.

7.12. Family discount – 2 paying adults with 1 to 4 children get a 10% discount on one to 5-day ski passes.

7.13. Group discount.  A group is a group of at least 20 people. When purchasing the same type of ski pass, a 5% discount or the 21st ticket is free. A list of names of the group members and the signature of the group leader are required.

7.14. 4-hour regional ski pass / all-day regional ski pass: The condition of the purchase and use: submit a proof of permanent residence in the Brezno district.

7.15. Combining discounts is not possible. The most favourable price for the customer applies.

  1. PRICE OF GOODS AND PAYMENT TERMS OF ONLINE SKI PASSES

8.1. The purchase price of online ski passes purchased in the online store corresponds to the prices listed in the standard price list of the SKI TÁLE resort, which is available at all ticket offices at the ski resort and also on the website www.tale.sk in the Price List section.

8.2. The customer always pays the price of the goods/services to the seller cashless via the Global payments, s. r. o. payment gateway, where he/she is redirected after confirming the order of the online ticket. After making the payment, the customer is informed on its successful transfer or failure and is redirected back to the online store site. If the payment is successful, the customer gets an e-mail “Confirmation of the purchase” with a payment receipt and a ticket in electronic form with a QR code. The payment receipt is also a tax document and the customer is obliged to keep it for possible complaints. If the payment is not successful, the customer is informed on the error and is redirected back to the last step in the online store. For issues arising during the payment via the Global Payments, s. r. o. payment gateway, its operator Global Payments, s. r. o. bears full responsibility and the customer is obliged to resolve any complaints about payments with Global Payments, s. r. o. If the customer does not get the e-mail with a QR code, he/she should immediately contact the technical support for online ticket purchases under the telephone number +421 48 6712 201, or send an e-mail to the address: ski@tale.sk.

8.3. Purchases through the Global Payments, s. r. o. payment gateway can be made at any time; the system is operational continuously except for technological breaks. The operator’s customers are informed on the planned technological breaks of the system and the resulting impossibility of making payments during this time period without undue delay on its website.

  1. USING A CHIP CARD WITH A SKI PASS

9.1. The contactless chip card must be inserted into a pocket on the left side of the clothing. Objects that may interfere with card reading (e.g. mobile phones, car keys, payment cards) should be placed on the right side of the clothing.

9.2. When passing through the turnstile, it is necessary to have only one chip card with a ski pass, as the authorization from another card of this type may be activated.

9.3. Each passage through the turnstile and card reading is signalled by a corresponding message on the reader display and a green light on the turnstile. The red light on the turnstile means that it is forbidden to pass through the turnstile.

9.4. After passing through the turnstile, the card is automatically blocked for a certain period of time (applies to timed ski passes), which prevents the use of the same card by another person.

9.5. A natural person who uses a timed card authorization is obliged to pay attention to the sound signals and messages displayed on the turnstile reader screen and follow the instructions and commands that result from this.

  1. LOSS, THEFT AND DAMAGE OF A SKI PASS

In the event of loss, theft or damage to a ski pass, the ski pass holder is not entitled to a refund of the amount paid or an aliquot amount or to any other form of compensation for days not used due to the loss or theft of the ski pass.

  1. COMPLAINTS AND COMPENSATION OF THE FARE

11.1. The provision of services by the company Tále, a.s. is governed by the relevant provisions of Act No. 40/1964 Coll. of the Civil Code, as amended, in conjunction with the relevant provisions of Act No. 250/2007 Coll. on consumer protection and on amendments to Act of the Slovak National Council No. 372/1990 Coll. on offences, as amended, and other generally binding legal regulations.

11.2. The visitor has the right to be provided with ski lift transport services in the agreed or usual scope, quality, quantity and time. Complaints are submitted at the ticket office of the ski resort.

11.3. The visitor is obliged to make claims for defects in services (complaint) without undue delay after he/she has established the reasons for making a complaint (defect or defects in transport services – failure to provide transport), in principle, on the day of the occurrence of the event complained of, otherwise the right to make a complaint expires.

11.4. The visitor is obliged to submit his/her ski pass when making a complaint. After examining the complaint, the operator decides on the method of handling the complaint immediately, in more complex cases within 3 working days. The period for handling the complaint does not exceed 30 days from the date of its submission. For the purposes of handling the complaint, the visitor is obliged to provide his/her contact details through which he/she is notified of the method of handling the complaint in the event that it is not possible to handle the complaint immediately after it is submitted. The visitor is obliged to provide the operator with the necessary cooperation required by the operator when handling the complaint.

11.5.1.

The operator may provide the ski pass holder with a fare reimbursement for the day on which the transport is not provided due to the outage of the transport facility for a period longer than 90 minutes and at the same time the transport capacity of the transport facilities at the ski resort is reduced – in the event that neither of the H130 and H100 ski lifts is in operation:

a) until 12:00 the ski pass holder is entitled to a fare reimbursement in the form of a 1-day ski pass valid at the Ski Tále ski resort,

b) from 12:00 the ski pass holder is entitled to a fare reimbursement in the form of a 4-hour ski pass valid at the Ski Tále ski resort.

11.5.2. A replacement ski pass is provided only for one-day and multi-day ski passes and family ski passes.

11.5.3. A replacement ski pass is not provided for 4-hour ski passes and evening skiing.

11.5.4. The right to obtain a replacement ski pass expires if the ski pass holder makes at least 1 passage through the turnstile after the ski lifts are put into operation.

11.6. The operator reserves the right to individually assess each case of a service complaint and assess the eligibility of the complaint and the visitor’s requirements, the provision of travel reimbursement, its method or amount.

11.7. A customer who purchases an online ski pass in an online store more than 14 days before the start of the ticket use is entitled to withdraw from the purchase contract and cancel the ticket without giving a reason for these 14 days.

11.8. When purchasing an online ticket in an online store less than 14 days before the start of the ticket use, the customer is entitled to withdraw from the purchase contract and cancel the ticket, but this must be done at least one day before the start of the ticket use. When changing the start date of the ticket use, the customer’s cancellation period is extended to a maximum of 14 days from the date of purchase of the ticket. A ticket with the same date of purchase and start of validity cannot be cancelled. The customer hereby acknowledges and confirms that if the ticket is purchased on the day of its use, he/she loses the right to withdraw from the contract.

11.9. Those ski passes that have not been used by the selected start date of use cannot be cancelled retroactively or have their validity extended and the customer is not entitled to a refund of the purchase price for these tickets.

11.10. A ticket purchased through the online store can be cancelled by e-mail or in writing in paper form (in the case of sending a written withdrawal from the contract in paper form, this must be delivered to the operator no later than the day before the day the ticket is used). Provided that paragraphs

11.7 and 11.8. of these General Terms and Conditions are met, the customer is credited with cash back to the bank account from which the tickets were purchased within 14 days of entering the cancellation.

11.11. Given the nature and design of the transport facilities, the operator is not responsible for any contamination of clothing and equipment caused in the event of adverse weather conditions (rain). The visitor can eliminate any damage by strictly following the ski track on the ski lift at a distance of 0.5 meters from the axis of the tow rope.

11.12. The ski resort operator is not liable for damages caused by force majeure, natural conditions, weather, the fault of the injured party or a third party, including a power outage that is not caused by fault and lasts less than 90 minutes continuously, as well as for all inconveniences independent of the actions of the operator’s employees.

11.13. To cancel a ticket, please send a request by e-mail to infotale@tale.sk. The customer is then informed of the successful cancellation of the ticket and gets the e-mail “Confirmation of the cancellation”.

  1. By purchasing a ski pass and using services at the Ski Tále ski resort, the visitor undertakes to comply with the instructions of the operator’s authorized employee, the transport conditions, these General Terms and Conditions and the White Code which is published on the company’s website www.tale.sk and available at the Ski Tále ski resort. The company Tále, a.s. is entitled to invalidate (block) the ski pass and thus prevent the visitor from using the services at the Ski Tále ski resort if it is discovered that the ski pass is being used by a person who is not authorized to use it. The discounted ski passes are valid only with a card proving the right to be issued a discounted ski passes. In the event of invalidation of the ski pass due to the violation of the General Terms and Conditions (in the case of misuse of the ski pass and the resulting unauthorized use of the services provided at the Ski Tále ski resort), the visitor is not entitled to any financial or non-financial compensation for the inability to use the services provided at the Ski Tále ski resort, nor is the visitor entitled to a refund of the price paid or an aliquot part thereof.
  2. The ski pass does not entitle its holder to carry out any business or other gainful activity (including ski school activities) on the ski slopes and in thee ski areas without the consent of the company Tále, a.s. as the operator and the relevant permits in accordance with the generally binding legal regulations. Without the consent of the operator, the use of the ski slopes and the ski areas for advertising purposes (e.g. placing sales stands, advertising equipment, etc.) is prohibited.
  1. GDPR

14.1. By purchasing and paying for the ski pass, the ski pass holder acknowledges that the personal data provided when purchasing the ski pass are processed in accordance with Act No. 18/2018 Coll. on the protection of personal data and on amending and supplementing certain acts (hereinafter referred to as the “Personal Data Protection Act”).

14.2. The operator has a legitimate interest in sending messages to the customer about its activities to provide information to the customer on current discounts and promotions.

14.3. If the customer has registered and created his/her user name and password, he/she is obliged to keep them safe. The operator is not liable for the consequences or damage caused by forgetting the data, providing them to a third party or failing to ensure their protection by the customer.

  1. FINAL PROVISIONS

15.1. These General Terms And Conditions shall enter into force and effect on 15 December 2024 and are valid and effective throughout the entire 2024/2025 winter ski season. These General Terms And Conditions shall apply to the provision of services – use of the ski lifts and the ski slopes at the Ski Tále ski resort. The ski passes issued by company Tále, a.s., which are valid at other ski resorts, are governed by the general terms and conditions valid at the given ski resort.

15.2. If any provision of these General Terms and Conditions is invalid or ineffective, or becomes so, instead of this provision, a provision according to the relevant legal regulations that is closest to this invalid or ineffective provision is used. Other provisions of the invalidity or ineffectiveness of such a provision are not affected.

15.3. In matters not regulated by these General Terms and Conditions, the rights and obligations of the parties are governed by the relevant provisions of Act No. 102/2014 Coll. on consumer protection in the sale of goods or provision of services based on a distance contract or a contract concluded outside the seller’s business premises, as amended, and the Civil Code, as amended.

15.4. The operator is entitled to amend or supplement the wording of these General Terms and Conditions. However, this provision does not affect the rights and obligations that arose during the validity of the previous wording of the General Terms and Conditions.

 15.5. The customer has the right to exercise and resolve his/her rights and claims out of court and for this purpose submit a proposal to initiate alternative dispute resolution with an alternative dispute resolution entity in accordance with Act No. 391/2015 Coll. on alternative dispute resolution and on amendments and supplements to certain acts (hereinafter referred to as “ADR”). ADR entities can be found on the websites http://www.economy.gov.sk/zoznam-subjektov-alternativneho-riesenia-spotrebitelskych-sporov/146987s and www.mhsr.sk .

15.6. The customer can also exercise his/her rights and claims through the European Online Dispute Resolution Platform, which is available online on the website http://ec.europa.eu/consumers/odr/index en.htm.

15.7. By purchasing an online ticket, the customer accepts without reservation all the provisions of these General Terms and Conditions, by which he/she is bound when concluding the purchase contract and by checking the box “I agree to the General Terms and Conditions” in the order form for online tickets in the operator’s online store, he/she expresses his/her explicit consent to these General Terms and Conditions.

15.8. The wording of the General Terms and Conditions that is available on the operator’s website on the date of conclusion of a specific purchase contract in the online store is considered valid and effective.
